5th Circ. Won't Toss Copyright Suit Against Televangelist

Law360, Los Angeles (August 15, 2013, 4:51 PM ET) -- The Fifth Circuit ruled in a split decision Wednesday that a lower court didn't abuse its discretion by allowing two musicians to vacate their dismissal of a copyright infringement suit accusing televangelist Joel Osteen's church of using their song after a licensing agreement expired.

The appellate court said the parties had agreed that the suit would be dismissed in New York and reinstated in Texas, where the musicians' publishing company, Yesh Music, originally filed the underlying suit and where Osteen's Lakewood Church is based.
