UCB Beats Apotex's IP Suit Over Drugmaking Process

Law360, Los Angeles (September 9, 2013, 4:34 PM ET) -- A Florida federal judge ruled Friday in favor of drugmaker UCB Inc. and against Canadian company Apotex Inc., which had accused UCB of copying a patented manufacturing process for a blood pressure medication, finding that the patent should never have been issued.
The decision comes after U.S. District Judge Donald M. Middlebrooks refused to dismiss the complaint in January, saying a lack of details about UCB’s process prevented him from determining no violation occurred. Apotex sued UCB, Pfizer Inc. and other rival generic-drug makers in separate...
