5th Circ. Sides With Drilling Co. In Worker's FMLA Suit

Law360, Los Angeles (September 9, 2013, 6:03 PM EDT) -- The Fifth Circuit found Monday that a Texas drilling services company wasn't necessarily obligated to reinstate a clerk under the Family Medical Leave Act following her maternity leave, because the responsibility was with the staffing services company that was her primary employer.

Affirming a Texas federal judge's dismissal of the employee's claims, the appellate court held that Keppel AmFELS LLC didn't interfere with temporary worker Jessica Cuellar's job by refusing to rehire her after she gave birth.
