Pay-For-Delay Remains Top Priority For Ramirez's FTC

Law360, New York (November 13, 2013, 9:53 PM EST) -- Challenging pay-for-delay deals remains one of the top priorities for the Federal Trade Commission under Chairwoman Edith Ramirez, with the two pending cases over the allegedly anti-competitive pharmaceutical patent settlements near the top of the agency's to-do list, Bureau of Competition Director Deborah Feinstein told Law360 on Wednesday.
Feinstein said that "Mission 1" for the FTC on pay-for-delay is winning those two challenges by using the U.S. Supreme Court's recent ruling in one of those cases that Hatch-Waxman Act patent settlements could be challenged under the antitrust laws. But...
