Law360, New York (June 10, 2008, 12:00 AM ET) -- Another attempt to dismiss a class action against milk producers for allegedly fixing the prices of milk was tossed on Friday, after a federal judge found that the plaintiffs' claims passed all the issues raised by the defendants.
The Southern Marketing Agency, a rural cooperative, and James Baird, the manager of a milk producer, filed the motion to dismiss, arguing that the plaintiffs had failed to state a claim upon which relief could be granted.
