Law360, New York (July 17, 2008, 12:00 AM EDT) -- The U.S. Supreme Court has stood accused in recent years of being hostile to employees’ rights. It was the hopes of employers, however, that were routinely dashed by the Court during its recently concluded 2007 term.

The most disappointing of these decisions for employers, perhaps, was the Court’s holding in CBOCS West Inc. v. Humphries that retaliation claims are actionable under 42 U.S.C. § 1981.
