4th Circ. Sets Stage For Disability Litigation Under ADA

Law360, New York (April 7, 2015, 10:24 AM EDT) -- The Americans with Disabilities Act Amendments Act of 2008 substantially broadened the definition of protected disabled persons under federal civil rights laws. Prior to the ADAAA, federal courts routinely dismissed Americans with Disabilities Act claims on summary judgment, concluding that the plaintiff was not sufficiently impaired to claim protection under the law. In response to these dismissals, Congress changed the definition of disability under the ADA. Most significant diagnosed medical conditions will qualify as ADA disabilities, regardless of lack of evidence of direct impact of the impairment on the plaintiff's work....
