Employer Must Pay All Costs Of Blood Test: 3rd Circ.

Law360, New York (September 5, 2008, 12:00 AM EDT) -- A federal appeals court has ruled that employers must pay for time employees spend getting tested for blood-borne pathogens to which they might have been exposed on the job, upholding two citations by the U.S. Occupational Safety and Health Administration against a Pennsylvania hospital.

The dispute dates back to two incidents in 2002 and 2004, when employees of nursing home operator Beverly Healthcare-Hillview were accidentally stuck with needles, risking exposure to blood-borne pathogens.
