Walgreen Seeks To Toss Wal-Vert Trademark Ruling

Law360, New York (October 8, 2008, 12:00 AM EDT) -- Walgreen Co. has filed a lawsuit seeking to overturn an administrative ruling finding that the name of the pharmacy chain's discount allergy medicine Wal-Vert is confusingly similar to Wyeth's Alavert.

In a complaint filed Monday in the U.S. District Court for the Northern District of Illinois, Walgreen claims the Trademark Trial and Appeal Board's decision Aug. 5 to uphold Wyeth's opposition to the Wal-Vert trademark registration was wrong.
