Law360, New York (October 29, 2008, 12:00 AM ET) -- A lawsuit against Sears, Roebuck & Co. for selling dryers allegedly misrepresented as having all-stainless-steel drums will no longer proceed as a class action, under an appeals court ruling issued Tuesday.
The U.S. Court of Appeals for the Seventh Circuit decertified the suit as a class action, overruling the U.S. District Court for Northern District of Illinois, which initially certified a class that included dryer purchasers in 28 states and Washington, D.C.
