Age Bias Claim Tossed From JPMorgan ERISA Action

Law360, New York (December 8, 2008, 12:00 AM EST) -- A judge presiding over litigation against JPMorgan Chase & Co.'s employee retirement plan has granted the plan's unopposed motion to dismiss the plaintiff's claim that it discriminates against older employee participants by definition.

The claim was tossed with prejudice from the consolidated class action complaint by Judge Denise Cote in an order issued Thursday in the U.S. District Court for the Southern District of New York.
