Welding Fume MDL Defendants End Tolling Deal

Law360, New York (December 08, 2008, 12:00 AM ET) -- After more than four years, the tolling agreement in multidistrict litigation over welding fumes has been terminated by the defendants, requiring roughly 12,000 participants to formally file complaints in the action if they want to pursue claims.

The tolling agreement, filed in June 2004 in the U.S. District Court for the Northern District of Ohio, suspended the statute of limitations for claims against the defendants in the welding fume litigation and permitted participants to sidestep the normal rules of civil procedure for initiating a case....
