Lee, issued June 20, 2016, the U.S. Supreme Court unanimously affirmed the decision of the Federal Circuit that the U.S. Patent and Trademark Office was authorized to adopt a rule specifying use of a broadest reasonable interpretation (BRI) claim construction standard. Moreover, a majority of the court affirmed the decision of the Federal Circuit that the statute barred Cuozzo's challenge to the PTO's decision to institute the IPR.
