Judge Tosses Toxic Tort Claims Against Cargill

Law360, New York (January 7, 2009, 12:00 AM EST) -- Shunning plaintiffs' calls for additional discovery, a federal judge has held that agricultural products giant Cargill Inc. is not liable for groundwater contamination in Nebraska, dismissing one suit outright and striking Cargill from another ongoing toxic tort case.

On Friday, Judge Richard G. Kopf of the U.S. District Court for the District of Nebraska granted summary judgment to Cargill in two linked lawsuits alleging the company is liable for groundwater pollution caused by the release of chlorinated solvents on property it once owned.
