Dollar General Upholds Tribal Jurisdiction Status Quo

Law360, New York (July 26, 2016, 4:15 PM EDT) -- On June 23, 2016, the Supreme Court of the United States issued a nine-word ruling in a closely watched case for Indian Country: "The judgment is affirmed by an equally divided court." So came the, perhaps temporary, end to Dollar General Corp. v. Mississippi Band of Choctaw Indians. The immediate effect of the court's nonruling will be that the Fifth Circuit Court of Appeals' decision will remain controlling law in Louisiana, Mississippi and Texas. It is unknown whether Dolgencorp Inc. (the Dollar General corporate entity) will attempt to appeal the Fifth Circuit decision again once a replacement for Justice Antonin Scalia is confirmed to the bench....
