Class' Arbitration Claims Against Discover Survive

Law360, New York (January 26, 2009, 12:00 AM ET) -- A class action against Discover Financial Services LLC alleging that the company conspired with other credit card companies to force cardholders into arbitration to settle disputes will be allowed to proceed, a federal judge has ruled.

Judge William H. Pauley III of the U.S. District Court for the Southern District of New York ruled Wednesday that the plaintiffs had made a strong enough case that discovery was needed in order to determine whether Discover had conspired with its industry brethren to deny cardholders' access to courts....
