Arbitrator Finds EEOC Willfully Violated FLSA

Law360, New York (March 27, 2009, 12:00 AM EDT) -- In a ruling that throws a spotlight on the U.S. Equal Employment Opportunity Commission’s overtime practices, an arbitrator has found that the agency should have offered some of its employees the option of extra pay rather than just compensatory time.

Arbitrator Steven M. Wolf determined on March 23 that the agency willfully violated the Fair Labor Standards Act through its nationwide practice of only providing time off for investigators, mediators and paralegals who worked overtime.
