Law360, New York (September 09, 2009, 12:37 PM ET) -- Wausau Underwriters Insurance Co. has asked a federal judge to throw out an insurance dispute in which Bank of America NA alleges that Wausau must reimburse the bank for litigation costs in an underlying case over environmental contamination.
Wausau filed a motion Tuesday in the U.S. District Court for the Western District of Washington, arguing that it has no duty to defend BofA because the bank violated terms of an insurance policy.
