Law360, New York (August 19, 2010, 5:41 PM ET) -- Paychex Business Solutions Inc. has been granted a separate trial on whether it can be considered an employer under the Fair Labor Standards Act in a collective action brought against the employee-leasing company by former loan officers at Premier Mortgage Funding Inc.
Judge Susan C. Bucklew of the U.S. District Court for the Middle District of Florida issued the ruling Tuesday, saying that a separate trial could save the parties time and money before they delve into other aspects of the case.
