Judge Tosses Three ERISA Claims, Lets One Remain

Law360, New York (September 07, 2006, 12:00 AM ET) -- A federal judge has thrown out three of the four claims leveled against PricewaterhouseCoopers LLP in a class action case alleging that a PWC benefit plan ran afoul of the Employee Retirement Security Act of 1974.

The four-claim complaint—filed in federal court in Manhattan on March 23—contends the Retirement Benefit Accumulation Plan for Employees of PricewaterhouseCoopers LLP violates ERISA’s rules for calculating lump-sum benefits payable from a cash balance pension plan, rules for figuring out accrued benefits and rules governing age discrimination.
