Law360, New York (May 10, 2012, 7:13 PM ET) -- A New York district court judge on Thursday upheld a bankruptcy judge's July 2011 decision allowing grocery store owner Great Atlantic & Pacific Tea Co. to hold onto a lease for an unused commercial space in a New Jersey shopping center.
The judge rejected arguments by the landlord of the shopping center, Androse Associates of Allaire LLC, that A&P, which held a 25-year lease for a supermarket at the Allaire Village Plaza, did not have a right to keep the store "dark."
