Netflix Plaintiffs Move Closer To Appeal

Law360, New York (August 22, 2007, 12:00 AM ET) -- Customers who have brought a putative antitrust class action against Netflix Inc. have decided not to amend their dismissed consolidated complaint, opening the door for a potential appeal.

The plaintiffs filed a letter Wednesday in the U.S. District Court for the Northern District of California notifying Judge William Alsup that they would not amend their consolidated complaint, which Alsup dismissed in June, by the court's Aug. 23 deadline for third-party discovery. The deadline to amend the complaint is Sept. 6, according to court documents.
