9th Circ. Shuts Down Laptop Defect Action Against HP

Law360, New York (March 05, 2009, 12:00 AM ET) -- A federal appeals court has affirmed the dismissal of a putative class action accusing Hewlett-Packard Co. of fraudulently concealing defects in its Pavilion-brand laptop computer screens in violation of California law.

The plaintiffs did not allege that all HP Pavilion inverters of the models covered by the proposed national class were substantially likely to fail, according to a memorandum issued Tuesday in the U.S. Court of Appeals for the Ninth Circuit.
