EMC Fights With HP Over Exec's Noncompete Clause

Law360, New York (April 29, 2009, 12:00 AM ET) -- An executive who left EMC Corp. earlier this week to join rival Hewlett-Packard Co. has purportedly become embroiled in a pair of lawsuits over the terms of a noncompete clause in his employee agreement.

The dispute began Monday, when David Donatelli resigned his position as president of EMC's storage division and indicated his intent to join a rival company, according to Michael Gallant, a spokesman for Hopkinton, Mass.-based EMC.
