Free Speech Defense Nixed In Hot Fuel MDL

Law360, New York (March 05, 2010, 7:13 PM ET) -- The federal judge overseeing a multidistrict litigation alleging a gasoline industry hot fuel conspiracy has ordered industry groups to fork over internal lobbying records, shooting down the defendants' argument that the First Amendment protects such activities.

Judge Kathryn H. Vratil of the U.S. District Court for the District of Kansas on Thursday reversed part of a magistrate judge's May 28, 2009, discovery order in the case, which accuses the oil industry of selling gas without adjusting for temperature expansion.
