6th Circ. Kills Tyson's Bid To Decertify Don, Doff Class

Law360, New York (March 25, 2010, 12:35 PM ET) -- A panel of appellate judges has put the kibosh on a move by Tyson Foods Inc. to decertify a class of workers who allege the poultry giant violated wage-and-hour laws at a Tennessee meatpacking plant.

The three-judge panel in the U.S. Court of Appeals for the Sixth Circuit on Wednesday denied Tyson's request for permission to appeal the conditional class certification a district court judge handed down in November in the donning and doffing case.
