Law360, New York (January 07, 2011, 6:56 PM ET) -- Embarq Corp. retirees have largely won their bid for class certification in a case accusing the telecommunications company of age discrimination and reducing retirement benefits.
Judge Eric F. Melgren of the U.S. District Court for the District of Kansas on Tuesday granted the plaintiffs' bid for class status on claims under the Employee Retirement Income Security Act and three state age discrimination laws. Melgren also granted collective status to the retirees under the Fair Labor Standards Act.
