Duke Fights ERISA Class Action

Law360, New York (August 23, 2007, 12:00 AM ET) -- Duke Energy Corp. has put up a fight against a class action by employees who claim the company's pension plan discriminates based on age, filing an opposition to the plaintiffs' motion for summary judgment.

Duke on Wednesday contested the employees' bid to end the case in a motion submitted in the U.S. District Court of South Carolina. The energy company also bid for partial summary judgment in its own favor, arguing that its pension plan does not violate the Employee Retirement Income Security Act.
