Law360, New York (May 16, 2012, 4:48 PM ET) -- The Third Circuit on Wednesday refused to revive two putative class actions alleging former pharmaceutical giant Schering-Plough Corp. marketed off-label uses for certain drugs, saying the suits both failed to allege a link between the company's marketing and any actual injuries.
The three-judge panel upheld a New Jersey court's June 2010 decision that dismissed both actions for the same reason, finding both Angela Montgomery and the International Brotherhood of Teamsters Local No. 331 Health & Welfare Trust Fund, the lead plaintiffs in their respective actions, failed...
