Law360, New York (August 18, 2008, 12:00 AM ET) -- A federal judge on Monday granted class status to drugstores and other outlets alleging that the makers of the anti-cholesterol drug TriCor prevented a generic version of the drug from reaching the market by filing a series of frivolous patent infringement lawsuits.
But the judge put on hold class certification for 18 states and the District of Columbia, which filed a similar case.
A move by Abbott Laboratories and Fournier Industrie et Sante to have both sets of litigation dismissed was denied.
