Trademark Claim Revived In Trojan Condom Antitrust Row

Law360, New York (May 17, 2012, 7:02 PM ET) -- A California federal judge on Wednesday revived a claim that Trojan condom maker Church & Dwight Co. Inc. had infringed Mayer Laboratories Inc.'s trademark for the term “microthin” in the two rivals' antitrust dispute.

Granting a motion for reconsideration, U.S. District Judge Edward M. Chen said he had incorrectly axed Mayer's trademark infringement counterclaim from the companies' sprawling antitrust suit over whether C&D unfairly used a rebate program to secure Trojans a prime spot on the shelves.
