FTC's Antitrust Suit Against Cephalon Moved To Pa.

Law360, New York (April 29, 2008, 12:00 AM ET) -- A lawsuit by the U.S. Federal Trade Commission alleging that Cephalon Inc. paid off would-be competitors in the market for its narcolepsy drug Provigil will be heard in Pennsylvania, over the FTC's objections.

On Monday, Judge John D. Bates of the U.S. District Court for the District of Columbia ruled that the Eastern District of Pennsylvania was the appropriate venue for the case. The FTC had argued that the case should be heard in the District of Columbia, where it was filed in February.
