Sixth Circuit Dissolves Class In Union Case

Law360, New York (January 22, 2007, 12:00 AM ET) -- The U.S. Court of Appeals for the Sixth Circuit has knocked down the certification of a class in a collective bargaining battle between a steelworkers union and the Cooper Tire & Rubber Company over whether a side agreement dispute is “arbitrable.”

On Wednesday, the appeals court handed down its split decision, vacating the district court’s ruling to grant certification while upholding the lower court’s finding that the issue at hand can be arbitrated.
