Law360, New York (December 12, 2011, 7:26 PM ET) -- Nonexempt hourly employees of Wal-Mart Stores Inc. on Friday hit the company with a putative class action in California court, claiming it had failed to properly pay overtime wages by miscalculating the workers' regular rate of pay.
A class of at least 500 current and former nonexempt hourly employees, helmed by lead plaintiff Dolores Sandoval, contends Wal-Mart improperly calculated the workers' overtime wages by failing to account for all remuneration paid in a period, in violation of California's Labor Code.
