Law360, New York (November 11, 2010, 5:51 PM ET) -- A federal appeals court has ruled that the Northwest Interstate Compact on Low-Level Radioactive Waste, a federally chartered regional organization, has authority over a nuclear waste site in Utah, scuttling EnergySolutions Inc.’s plans to import foreign radioactive materials to the site.
Judge Timothy M. Tymkovich handed down his opinion Tuesday in the U.S. Court of Appeals for the Tenth Circuit, finding that the Northwest Compact permitted the organization to reject low-level radioactive waste that originated outside of its region.
