Law360, New York (February 23, 2009, 12:00 AM ET) -- The U.S. Supreme Court on Monday decided not to review an appeals court opinion that struck down a Bush administration rule related to the regulation of mercury emissions from power plants.
In denying cert to the Utility Air Regulatory Group, an organization of electric utilities and trade associations, the high court ended any hope that the U.S. Environmental Protection Agency's Clean Air Mercury Rule would stand.
