Emissions Rule Violates Federal Law: Pork Groups

Law360, New York (March 23, 2009, 12:00 AM ET) -- Two pork industry groups have moved for summary judgment on their claim that a federal rule requiring large farms to report animal waste emissions to state and local officials violates a federal statute exempting "routine agricultural operations" from emissions reporting requirements.

On Friday, the National Pork Producers Council and the Wisconsin Pork Association moved for summary judgment on one of four counts pending against the U.S. Environmental Protection Agency in the U.S. District Court for the Western District of Wisconsin.
