Law360, New York (March 02, 2011, 7:53 PM ET) -- A federal judge in Kentucky on Wednesday refused to dismiss State Farm Fire & Casualty Co.’s declaratory judgment suit over underlying negligence claims that a drug-testing company forced individuals to submit urine samples in front of its employees.
Judge Charles R. Simpson of the U.S. District Court for the Western District of Kentucky rejected Accurate Drug & DNA Testing Corp.’s argument that it would not be appropriate for the federal court to assume jurisdiction over the case under the Declaratory Judgment Act.
