Fed. Circ. Quashes $723M Import Surety Bond Suit

Law360, New York (February 08, 2012, 8:08 PM ET) -- U.S. honey, garlic, mushroom and crawfish producers cannot reinstate a $723 million proposed class action over allegedly negligent anti-dumping duty surety bonds issued by Hartford Fire Insurance Co. and others, the Federal Circuit ruled Tuesday.

A three-judge panel upheld the U.S. Court of International Trade’s dismissal of the case, but found different reasons to do so.

The appeals court dismissed charges against the surety defendants on the grounds that the CIT never had jurisdiction to hear the case in the first place.
