Law360, New York (September 07, 2012, 1:44 PM ET) -- JAR Laboratories LLC lodged a suit against the Great American E&S Insurance Co. on Thursday in Illinois, demanding that the insurer defend the company in a false advertising suit over its over-the-counter pain relief patch LidoPatch.
In a complaint filed in Illinois federal court, JAR Labs claims that Great American unlawfully refused to defend the company in an underlying suit brought by Teikoku Pharma USA Inc. that alleged a press release comparing the LidoPatch to Teikoku’s Lidoderm patch was false.
