DOL Guidance On Wellness Programs Is Good News

Law360, New York (March 14, 2008, 12:00 AM ET) -- Giving with one hand and taking away with the other, the U.S. Department of Labor’s Employee Benefits Security Administration (“EBSA”) has issued two recent Field Assistance Bulletins concerning the new regulations on the wellness program exception to the Health Insurance Portability and Accountability Act (“HIPAA”) nondiscrimination rule.

The first of the two bulletins closes a significant loophole to the regulations. The second bulletin offers several helpful clarifications to the regulations that will reduce the burden associated with implementing a wellness program.
