OFT Accuses Reckitt Of Limiting Generic Access

Law360, New York (February 23, 2010, 1:06 PM ET) -- The U.K. Office of Fair Trading has alleged that Reckitt Benckiser Group PLC abused its dominant market position by withdrawing its National Health Service supply of Gaviscon heartburn medication before the NHS would have allowed pharmacies to offer generic alternatives of the treatment.

The regulator alleged Tuesday that Reckitt Benckiser timed the withdrawal of NHS packs of Gaviscon Original Liquid from the NHS prescription channel so it would occur before the publication of the generic name for the product.
