GUI Patents Survive Red Hat, Novell Challenge

Law360, New York (March 30, 2010, 2:45 PM ET) -- A federal judge has refused to invalidate three graphical user interface patents that Linux providers Red Hat Inc. and Novell Inc. contend incorrectly name three inventors as joint developers.

Judge Randall R. Rader sitting by designation on the U.S. District Court for the Eastern District of Texas on Monday rejected the defendants’ bid for summary judgment in the suit brought by IP Innovation LLC and Technology Licensing Corp., finding that enough issues concerning the invention of the patented technology exist to withstand dismissal.
