Ex-USPTO Bigwig Allowed To Testify In Chip Patent Suit

Law360, New York (September 23, 2010, 12:59 PM ET) -- A federal judge has ruled that Winbond Electronics Corp., Asus Computer International and other defendants in a patent infringement suit over computer chip software can use a former U.S. Patent and Trademark Office commissioner as a witness, despite the plaintiff's contention that he is not qualified.

Ex-Commissioner Nicholas Godici will not be able to weigh in on as many issues as the defendants had hoped, though, Judge Ted Stewart of the U.S. District Court for the District of Utah said Tuesday.
