Fed. Circ. Rejects McKesson's Bid To Revive IP Suit

Law360, New York (April 12, 2011, 6:21 PM ET) -- A divided Federal Circuit panel on Tuesday rejected McKesson Technologies Inc.'s bid to revive its suit claiming that Epic Systems Corp. indirectly infringed its patent covering a way in which health care providers and patients can communicate.

Judge Richard Linn of the U.S. Court of Appeals for the Federal Circuit wrote an 11-page opinion affirming a trial court's Sept. 2009 decision to grant summary judgment of noninfringement to Epic, ruling that McKesson could not attribute the performance of all the steps of the asserted method claims...
