EU Court Nixes Nike Win In 'Swoosh' Trademark Dispute

Law360, New York (September 27, 2011, 6:03 PM ET) -- The European Union's General Court decided Tuesday that an EU trademark agency erred when it ruled in favor of Nike International Ltd. in a suit alleging a Spanish man had attempted to register a mark for a logo similar to Nike's “swoosh” symbol.

The Luxembourg-based tribunal said the Office for Harmonization in the Internal Market had issued a contradictory decision that included in two separate paragraphs the conflicting opinions that there both was and was not a similarity between the two marks.
