Law360, New York (September 29, 2011, 1:25 PM ET) -- A New York federal judge on Wednesday sent to arbitration a photographer’s lawsuit against Pearson Education Inc. over the textbook publisher’s alleged unauthorized use of his photos in several science books.
U.S. District Judge John F. Keenan dismissed photographer Brandon Cole’s suit without prejudice in light of an arbitration clause in a licensing agreement.
“The court considers the arbitration clause enforceable for purposes of deciding this motion to dismiss the claims in favor of arbitration,” Judge Keenan said.
