Law360, New York (February 23, 2012, 4:27 PM ET) -- A New York federal judge on Thursday tossed Times Square mainstay the Naked Cowboy’s trademark infringement suit against CBS Corp., finding the network’s use of a scantily clad cowboy character in a soap opera did not violate the entertainer’s rights.
U.S. District Judge Barbara Jones noted in her order that the episode of CBS’ daytime soap “The Bold and the Beautiful” featuring a briefs-and-cowboy-hat-sporting guitar player that inspired the lawsuit did not contain the phrase “naked cowboy” at any point throughout, and therefore does not infringe...
