EPA Must Await Ruling Before Disclosing Power Plant Data

Law360, New York (May 04, 2012, 7:53 PM ET) -- A Montana federal judge on Thursday ruled that the U.S. Environmental Protection Agency cannot disclose data about PPL Montana LLC's Colstrip power plant until the court decides on the company's preliminary injunction bid after it claimed the data includes trade secrets.

U.S. District Judge Richard F. Cebull granted PPL Montana’s motion to prevent the release of the data to the Sierra Club and the Montana Environmental Information Center, which had filed a Freedom of Information Act request with the EPA for the 12-page document.
