Law360, Los Angeles (May 22, 2012, 8:42 PM ET) -- A New York federal judge on Tuesday dismissed an unfair competition claim from a copyright lawsuit brought by a group of television broadcasters seeking to shut down Aereo Inc. from offering its online streaming service.
U.S. District Judge Alison J. Nathan said that the federal Copyright Act's express preemption provision bars the unfair competition claim brought under New York state law. The ruling leaves two copyright infringement claims in the case.
